Washington Consumer Health Data Privacy Policy

This Washington Consumer Health Data Privacy Policy is provided pursuant to the Washington My Health My Data Act and supplements the Atmee.ai Privacy Policy. Any terms not defined herein have the definitions set forth in the Atmee.ai Privacy Policy or Terms of Use.
Collection of Consumer Health Data
“Consumer Health Data” means personal information that is linked or reasonably linkable to a consumer and that identifies the consumer's past, present, or future physical or mental health status. Consumer Health Data does not include information that is publicly available, de-identified, or aggregated.
Categories of Consumer Health Data We Collect
The Consumer Health Data we collect may include biometric information, as described in the Biometric Information section of Atmee.ai’s Privacy Policy. Note that we only collect Consumer Health Data (i.e. biometric information) pertaining to users in order to create and operate their Atmee.ai Avatars. We may also collect other Consumer Health Data if you choose to include this information in communications with Atmee.ai Avatars on the Services.
Categories of Sources of Consumer Health Data
As described in the Categories of Sources of Personal Data section of Atmee.ai’s Privacy Policy, we may collect Consumer Health Data directly from you (or your representative) when you use our products and services.
Our Purposes for Collecting and Using Consumer Health Data
We collect, use, disclose, or otherwise process your Consumer Health Data (specifically, biometric information) as reasonably necessary for various purposes as described in the Biometric Information and Other Permitted Purposes for Processing Persona Data sections of Atmee.ai’s Privacy Policy but primarily to provide you with products and services as you have requested or authorized.
How We Disclose Your Consumer Health Data
We disclose Consumer Health Data to our service providers, including hosting providers and other service providers that process information for Atmee.ai and/or make certain services, features or functionality available to users on our behalf. Our service providers are contractually restricted with respect to their use and disclosure of information they host and process on behalf of us. If you choose to provide Consumer Health Data in conversations with an Atmee.ai Avatar, note that the holder of the Atmee.ai Avatar may receive access to this information.
Washington Consumer Health Data Rights
If you are a Washington resident or we have collected your Consumer Health Data in Washington, you have rights set forth in this section subject to certain exceptions.
- Access: You have the right to request confirmation of or access to the Consumer Health Data that we process about you, including a list of all third parties and affiliates with whom we have disclosed or sold your Consumer Health Data and their contact information.
- Deletion: You have the right to request that we delete the Consumer Health Data that we have collected about you.
- Withdraw Consent: You have the right to withdraw consent from us collecting and disclosing your Consumer Health Data.
- Appeal: If we refuse to take action on your request within a reasonable period of time after receiving your request in accordance with this section, you may appeal our decision. If we deny your appeal, you have the right to contact the Washington Attorney General at www.atg.wa.gov/file-complaint.
To exercise your rights, you must send us a request that (1) provides sufficient information to allow us to verify that you are the person about whom we have collected Personal Data (if you are an account-holder, we may ask you to log-in to your account), and (2) describes your request in sufficient detail to allow us to understand, evaluate and respond to it. Each request that meets both of these criteria will be considered a “Valid Request.” We may not respond to requests that do not meet these criteria.
