Biometric Data Policy

Biometric Consent Form
In order for Atmee.ai to generate and display an interactive digital avatar ("Atmee.ai Avatar") of the user, and operate and improve the Services, Atmee.ai may derive biometric information from photos, videos and audio recordings of the user. This Biometric Consent Form provides information regarding Atmee.ai's collection, use, disclosure and retention of biometric information. Any terms not defined herein are defined under the Terms of Use.
Biometric Information:
The Illinois Biometric Information Privacy Act, 740 ILCS 14/1, et deq. ("BIPA") and certain other state biometric privacy laws regulate the collection, storage, use, disclosure, and retention of "biometric identifiers" and "biometric information." "Biometric identifier" means a retina or iris scan, fingerprint, voiceprint, or scan of hand or face geometry. Biometric identifiers do not include, among other things, photographs or physical descriptions such as height, weight, hair color, or eye color. "Biometric information" means any information, regardless of how it is captured, converted, stored, or shared, based on an individual's biometric identifier used to identify an individual.
In connection with the user's use of the Services and Atmee.ai's generation of the Atmee.ai Avatar, Atmee.ai derives data that may be considered "biometric information" under privacy laws such as BIPA from audio, photos, and video of the user. Such biometric information may include a scan of facial geometry, voiceprint, and/or other physiological measures intended to capture the likeness of the user. Atmee.ai captures and uses this data to create, operate, and make available to other users a realistic Atmee.ai Avatar on the Services, and to train and improve Atmee.ai's models and consequently its Atmee.ai Avatars.
Other Important Considerations:
Disclosure: Atmee.ai may disclose your biometric information to its service providers, including hosting providers and other service providers that process information for Atmee.ai and/or make certain services, features or functionality available to users on its behalf. Atmee.ai's service providers are contractually restricted with respect to their use and disclosure of information they host and process on behalf of Atmee.ai.
Retention: Atmee.ai retains a user's biometric information for the duration of the Agreement, unless a different retention period is required by law. Illinois residents' biometric information will be retained until the earlier of (i) the initial purpose for collecting or obtaining such biometric information has been satisfied or (ii) three years following the Creator's last interaction with us. Once the retention periods in this section have expired, Biometric Information will be permanently and irretrievably deleted by Atmee.ai.
